Terms and Conditions.

 

Definitions
In our Terms and Conditions, “us”, “we” or “our” refers to Empower Pilates Group Pty Ltd (ABN 48 647 518 938). ‘You’ or ‘your’ refers to the member or purchaser.

By signing up to participate in our classes, you agree to be bound by our Terms and Conditions set out below. These terms and conditions may change at Empower Pilates Group Pty Ltd’s discretion, and you may or may not be notified of this change.

 

Membership Terms and Conditions

IMPORTANT: THIS IS AN ONGOING MEMBERSHIP WHICH WILL BE DEBITED FROM YOUR ACCOUNT MONTHLY OR FORTNIGHTLY UNLESS YOU CANCEL IT AS PER THE TERMS AND CONDITIONS BELOW.

Each new membership has a minimum of 2 months activation.

Each month/fortnightly period the member receives an allocated number of classes as per their membership classification (e.g. Gold Membership) to utilise as they wish throughout that month period.

Classes do not roll over to the next month. Anything not used within that month will be forfeited. No refunds will be given on unused classes. 

Membership dues are paid monthly/fortnightly and are continuous and auto renewing. It is the members responsibility to ensure adequate funds available in their account prior to membership payment being taken. Empower Pilates Group Pty Ltd is not liable for any late payment charges or membership disruption as a result of inadequate funds.

We offer all our members 1 ‘free’ pass per month. These can be utilised on those days when you cannot make it to a class you have booked. Once you have used up your monthly ‘free’ pass you will either lose your session (Silver & Gold and fortnightly members) or be charged $10 late cancel fee (Monthly Platinum members) if you do not cancel within the 6 hour cancellation window. Please ensure that you still cancel out of your class in the MINDBODY app so that we can offer your space to someone else. Please read our Late Cancellation Policy for more information. Recurrent no shows will not be tolerated.

Members can suspend their membership payments for up to 3 months per year, at no cost. To suspend your membership, 14 days’ notice prior to your next auto payment must be provided in writing to hello@empowerpilatesstudios.com.au.

Additional reformer classes for members are charged at a lower rate than casual classes. The additional class price for members is $17.50. Additional class payments will be automatically charged at the end of your cycle. It is the members responsibility to keep track of their allocated classes to avoid any additional class costs accruing.

There is no ‘lock in’ contract or ‘pay out figures’ to our memberships. You can cancel at any time after the completion of your initial 2 months. To cancel your membership, 14 days’ notice prior to your next auto payment must be provided in writing to hello@empowerpilatesstudios.com.au.  If 14 days’ notice has not been given prior to the next auto payment your membership will be cancelled prior to the next auto payment.  You will still be able to use your classes that have been paid for until the end of that cycle. Please note that memberships cannot be cancelled via the app or website or by simply removing your card from your account. 

 

Class Pack Terms and Conditions

All classes must be pre-paid before attending. You may do this when booking your place in a class, via a pre-paid pack or as a casual attendee.

Class packs are non-transferrable between holders, and may not be sold, traded, gifted, shared, provided, or otherwise transferred to any person other than the purchaser.

Advertised pricing is final, we cannot offer casual classes at membership prices so please don’t ask as refusal may offend.  Refunds cannot be provided for change of mind. 

All class pack purchases are subject to expiration. 5 class passes have a 3-month expiry, 10 class passes have a 6-month expiry, 20 class passes have a 9-month expiry, and 30 class passes have a 12-month expiry. Please consider this when making your purchase.

Class pack purchases are subject to our Late Cancellation Policy.

 

Late Cancellation Policy

Classes cancelled more than 6 hours prior to class start time are considered an ‘early cancel’ and will result in your class being credited to your account in full.

Classes cancelled within 6 hours of the class start time are considered a ‘late cancel’ and will result in a loss of the class. For Platinum memberships, a $10 late cancellation fee will be applied. All membership holders have 1 ‘free’ pass per month to utilise in these instances. Any ‘late cancels’ above this will be subject to this Late Cancellation Policy.

Empower Pilates Group Pty Ltd clients can book classes up to 30 days in advance. We understand that plans change, people get sick, life happens. However, it is the members responsibility to ensure that they cancel out of any classes they no longer wish to attend. This can be done via the MINDBODY app, our Empower app or our website. Cancellations via phone call and/or text message and/or Instagram DM will not be accepted. Negligence to cancel within the designated timeframe stated above may result in loss of class or late cancellation fees. Cancellation fees have been set in accordance with Australian Consumer Law and are designed to be ‘fair and reasonable compensation for the lost and irreplaceable income each 'late cancellation' typically represents.

Classes must be cancelled if you are unable to attend, regardless of whether you are eligible for a credit or not. We require you to adhere to this policy as a courtesy to other clients wanting to attend classes and to our Instructors.

Recurrent no shows will not be tolerated and may be subject to a $15 ‘no show’ fee at Empower Pilates Group Pty Ltd’s discretion.

 

Payment Terms and Conditions

Payments for class packs can be made via bank direct debit, credit card or cash. Please note that cash can only be accepted during reception hours. Credit card payments will be charged an additional 2% surcharge.

Payments for memberships MUST be attached to a credit card or bank account to be processed.  They must be associated with a MindBody account so that class bookings can be made within that system.  We cannot accept cash for membership payments so please take this into consideration.

Empower Pilates Group Pty Ltd do not offer refunds due to change of mind so please consider your purchase carefully. An account credit or pack/membership extension may be offered at our discretion.

 

Entry Terms and Conditions

Smoking is prohibited inside and out the front of our Studios at all times.

You are required to treat all other participants, Instructors, staff, and property at the Empower Pilates Group Pty Ltd with all due care and respect.

Please must refrain from wear clothing which contains offensive prints or designs.

For hygiene purposes it is compulsory to wear grip socks if you are attending reformer classes. If you do not have a pair of these, you can purchase from reception or a sports store.

For the enjoyment of all participants in your class please turn all mobile phones to silent before your workout unless there are extenuating circumstances where you need it to be audible. Please let your Instructor know if this is the case.

 

Liability Waiver

Please read the following terms carefully. By participating in any class provided by Empower Pilates Group Pty Ltd (the Studio) you consent to and agree to release the Instructor and Studio from liability according to, these terms. Unless Empower Pilates Group Pty Ltd notifies you otherwise, this waiver and release will apply to all classes undertaken by you at the premise.

You acknowledge that:

• you are over 18 years of age; or if under (15 and above only) your guardian has agreed to your participation and is in attendance with you.

• you understand that the classes are a form of physical activity and that there are inherent risks in undertaking any form of physical exercise.

• you have disclosed, or will disclose to Empower Pilates Group Pty Ltd and its Instructors prior to the class commencing, any pre-existing conditions that may place you at a higher risk of injury or inhibit your ability to participate in a class, this includes, but is not limited to:

·         injuries, pain or recent surgery;

·         pregnancy or if you have recently given birth; or

·         respiratory or heart conditions or high blood pressure.

• you will notify Empower Pilates Group Pty Ltd and its Instructors if you experience any pain throughout the class and will immediately stop participating in the class if requested by the Instructor to do so.

• based on information you provide, Empower Pilates Group Pty Ltd and/or its Instructors may decide not to allow you to participate in a class, or may require you to provide a medical certificate affirming that you are able to participate in a class before allowing you to join, in the Instructor’s sole discretion.

• Recommendations or instruction provided by Empower Pilates Group Pty Ltd, and its Instructors may not be tailored for your particular skill or ability level and it is your responsibility to assess whether you are able or want to participate in all or part of a class.

• You are solely responsible for ensuring that your physical environment is suitable for your participation in any class. If it is not suitable please inform the Instructor.

• Classes may be recorded for by Empower Pilates Group Pty Ltd and its Instructors for quality control, as well as promotional purposes. If you do not consent to Empower Pilates Group Pty Ltd using video or still images taken during the class for promotional purposes, please notify us.

To the extent permitted at law, you release and hold Empower Pilates Group Pty Ltd and it’s Instructors (and where applicable its, directors, employees and representatives) harmless from any liability, cost, expense, damages or claims (including claims of negligence) arising from or which may be suffered or incurred in connection with your participation in any classes provided by Empower Pilates Group Pty Ltd and it’s Instructors.

By signing up for our classes and/or membership, it is assumed that you have read and understood these conditions of liability and will therefore be bound by them.
